General Conditions of the Online Store

These General Terms and Conditions are designed to regulate the terms and conditions governing the Online Shop Baby Bonnet, of Studio D - Soluções Globais de Publicidade, Lda., located at Rua dos Combatentes da Grande Guerra, 145; 4820-250 Fafe, Portugal, under corporate identity number 506843467, hereinafter referred to as Baby Bonnet.

The Service consists of the provision, through the address www.babybonnet.pt, of information on a set of products and allows the user to order them online, under the terms and conditions described herein.

The ordering of products must be made by Users who are 18 (eighteen) years old or older (individuals under that age must have written authorization from their legal representatives).

 

Product Information and Contents

Baby Bonnet will do everything possible so that the information presented is complete and does not contain typographical errors, and will be quickly corrected whenever they occur. If you purchase a product that has characteristics different from those presented online, you have the right to proceed to the resolution of the purchase agreement in accordance with applicable legal terms (right of free resolution - see \"Return Policy\"). It should be noted that there are understandable differences in the tone of a product that the customer sees on its screen and the reality (for example, photo backdrops) due to different calibrations in monitors. This justification for slight mismatches between the screen and the received product will therefore not be taken into account at the time of the request and return / exchange. Still, in handmade articles, we can expect insignificant differences between what the customer receives and what is presented, due to the fact that the products are not made by machines, but precisely by hand and each piece is unique in the world.

Baby Bonnet will do everything possible to send all the ordered products, but in certain cases, and due to causes not controllable by Baby Bonnet (such as human errors or incidences in the computer systems) it is possible that some of the requested products would not be available. If any product is not available after the User have placed the order, he will be notified by e-mail or by phone. At this point the User will have three options; 1. to cancel the order (totally or partially) with the respective refund if the User have already made the payment; 2. to exchange the unavailable item for another; 3. to receive a discount voucher of equal value for a next purchase.

All information about price, products, specifications, promotions and services may be changed at any time by Baby Bonnet without prior notice.

 

Responsibilities

All products sold on Baby Bonnet are in accordance with Portuguese Law.

The store has adequate security levels, however Baby Bonnet will not be responsible for any damages suffered by the User and / or third parties, due to delays, interruptions, errors and suspensions of communications caused by factors beyond Baby Bonnet’s control, like gaps or failures caused by the communications network or communication services provided by third parties, the computer system, modems, connection software or computer viruses. If for any reason the User can’t access Baby Bonnet Online Store to purchase some products, then Baby Bonnet will not be liable for any damages.

Baby Bonnet shall not be liable for any loss or damage caused by abusive uses of the Service that are not directly attributable to it as an intent or gross negligence.

Baby Bonnet is not liable for non-compliance resulting from the occurrence of force majeure situations, that is, situations of an extraordinary or unforeseeable nature, external to Baby Bonnet and that can not be controlled, such as fire, power outages, explosions, wars, riots, government decisions, strikes, earthquakes, floods or other natural disasters or other situations not controllable by Baby Bonnet that forbids the fulfillment of the assumed obligations.

Baby Bonnet does not guarantee, therefore, that the services of the online store are provided without interruption and without errors.

The User is responsible for the correct use of any product obtained through the Baby Bonnet online store, being also responsible for any damage caused by its misuse.       

 

Consumer Obligations

The user is responsible for:

i) Provide correct personal data and addresses;

ii) Do not use false identities;

If any of the data is incorrect or insufficient, and therefore there is a delay or impossibility in the processing of the order or delivery, the responsibility is attributed to the User, and Baby Bonnet declines any fault. In case of the consumer violates any of these obligations, Baby Bonnet reserves the right to cancel future purchases, block access to the store and cancel the provision of any other services to the same User.

The use of purchased products for commercial purposes, especially for the purpose of reselling, is expressly prohibited.

 

Shipping

All products are shipped in perfect condition to the customer. The customer must notify the logistics company (or postman) if he / she detects signs of damage to the packaging (rips, holes, attempted opening) and refuses delivery. In these situations, a new product will be shipped without any charge to the customer.

On the other hand, the exchange of a product for the reasons described above, but whose notification is not made to the carrier or postman on delivery, can not be met by Baby Bonnet.

Baby Bonnet declines any responsibility for delays in delivery of orders by the logistics company, especially in case of loss of merchandise or strikes, but it’s committed to obtaining the best alterative solution for the User.

 

Complaints

The User may submit any contractual conflicts to the arbitration and mediation mechanisms that are legally constituted, as well as claim from Baby Bonnet acts and omissions that violate the legal provisions applicable to the acquisition of goods, using the “online claim book” link or the email geral@babybonnet.pt.

The complaint must be filed within a maximum period of 30 (thirty) days, counted from the knowledge of the facts by the User, being recorded in the information systems of Baby Bonnet that should notify the interested party within a maximum period of thirty days from the date after receiving the complaint.

 

Applicable law

The Contract is governed by Portuguese law.
